These Terms constitute a legally binding agreement between you and Big Texan Steak Ranch ("we," "us," or "our") governing your access to and use of our Website and services.
Eligibility
To use our Website, you must:
- Be at least 13 years of age to browse the Website
- Be at least 18 years of age (or the age of majority in your jurisdiction) to make purchases
- Reside in or ship to an address within the contiguous United States
By using our Website, you represent and warrant that you meet these eligibility requirements.

If you create an account on our Website, you are responsible for:
- Maintaining the confidentiality of your login credentials
- All activities that occur under your account
- Ensuring the information in your account is accurate and current
- Notifying us immediately of any unauthorized access or use
We reserve the right to disable any account if we reasonably believe you have violated these Terms.
Products and Orders
Product Descriptions
We strive to accurately describe our products, including images, weights, and specifications. However, we do not warrant that product descriptions, images, or other content on our Website are error-free, complete, or current. Actual products may vary slightly from images shown.
Pricing
All prices are displayed in U.S. dollars and are subject to change without notice. We are not responsible for typographical or pricing errors. In the event of an error, we reserve the right to cancel orders and issue refunds.
Order Acceptance
We reserve the right to refuse or cancel any order for any reason, including but not limited to:
- Product availability issues
- Errors in pricing or product description
- Errors in your order
- Suspected fraud or unauthorized transaction
- Inability to verify payment information
If we cancel your order after payment has been processed, we will issue a full refund.
Food Safety and Handling
SAFE HANDLING INSTRUCTIONS: This product was prepared from inspected and passed meat. Some food products may contain bacteria that could cause illness if the product is mishandled or cooked improperly. For your protection, follow these safe handling instructions.
Safe Cooking Temperatures (USDA Recommended)
Use a food thermometer to ensure meat reaches a safe internal temperature:
- Steaks, roasts, and chops (beef): 145F (63C) with a 3-minute rest time
- Ground beef (burgers, patties): 160F (71C) - no rest time needed
Safe Storage
- Keep frozen at 0F (-18C) or below until ready to use
- Vacuum-sealed frozen steaks maintain best quality for 4-12 months in the freezer
- Thaw in the refrigerator (40F/4C or below) - allow 24 hours per 1-2 lbs of meat
- Alternatively, thaw in cold water (change water every 30 minutes) or in the microwave (cook immediately after)
- Never thaw meat on the counter or in hot water
- Once thawed, cook within 1-2 days. Do not refreeze raw meat that has been fully thawed in the refrigerator unless you cook it first
Safe Handling
- Keep raw meat separate from other foods at all times
- Wash hands thoroughly with soap and warm water before and after handling raw meat
- Wash cutting boards, utensils, and surfaces that have contacted raw meat with hot soapy water
- Never place cooked food on a surface that held raw meat without washing it first
- Refrigerate or freeze leftovers within 2 hours of cooking (1 hour if above 90F/32C)
Temperature Danger Zone
Bacteria grow rapidly between 40F and 140F (4C-60C). Never leave raw or cooked meat in this temperature range for more than 2 hours (1 hour if the ambient temperature is above 90F).
Customer Responsibility: From the time of delivery to your address, you are solely responsible for the proper and safe handling, storage, preparation, cooking, and consumption of all products. Big Texan Steak Ranch is not liable for any illness, injury, or adverse reaction resulting from improper handling, storage, or preparation of products after delivery.
Allergen and Cross-Contamination Disclosure
ALLERGEN WARNING: Our products are packaged and processed in facilities that also handle foods containing common allergens, including but not limited to milk, wheat, egg, soy, fish, shellfish, peanuts, tree nuts, and sesame. We cannot guarantee that cross-contamination will not occur between products.
Please be aware of the following:
- Beef is a known allergen for individuals with Alpha-gal syndrome (alpha-gal allergy), a tick-borne condition that causes allergic reactions to red meat
- Our products may contain or come into contact with allergens not listed on individual product pages
- If you have any food allergies or sensitivities, please consult your physician before ordering
- We are unable to guarantee that any product is free from any specific allergen
By placing an order, you acknowledge that you have reviewed this allergen disclosure and accept the inherent risks associated with food allergens and cross-contamination.
Shipping and Delivery

- We ship to the 48 contiguous United States only
- We cannot ship to Alaska, Hawaii, U.S. territories, P.O. boxes, or international addresses
- Shipping times are estimates and not guarantees
We are not responsible for delays caused by carriers, weather conditions, natural disasters, or circumstances beyond our control. Title and risk of loss pass to you upon delivery to the carrier.
Returns and Refunds (Perishable Goods)
No Returns on Perishable Products. Due to the perishable nature of our products, we cannot accept returns on orders that arrive in proper condition. Documented delivery and quality issues are reviewed as described below.
Damaged or Defective Orders
If your order arrives damaged, warm, thawed beyond safe temperature, or not in acceptable condition:
- Contact us within 24 hours of delivery for temperature or transit-condition issues
- Include photos of the packaging and product condition
- We will review the issue and may replace affected items, refund affected items, or issue store credit depending on the situation
Quality Issues
If you notice a quality issue after thawing, contact us within 7 days of delivery with photos and your order number. We will review the issue and work with you on the right resolution.
Change of Mind
Because our products are perishable, we cannot offer refunds for change of mind, buyer's remorse, or orders where the product was delivered in proper condition. This policy applies to all perishable food orders.
To report an issue, email customerservice@bigtexan.com with your order number and description of the problem.
California Customers: Per California Civil Code Section 1723, this refund policy applies to all perishable food products. We do not provide refunds on perishable goods that arrive in proper condition. This policy is displayed before checkout and in these Terms.
Please note: We pack orders for cold-chain transit and review documented delivery-condition issues. We do not guarantee specific delivery dates, though we make every effort to meet estimated timeframes.
Subscriptions and Auto-Renewal
AUTOMATIC RENEWAL NOTICE: When you sign up for a subscription, you are agreeing to a recurring charge. Your subscription will automatically renew at the end of each billing cycle until you cancel. Please read the following terms carefully.
Subscription Terms
When Subscribe & Save enrollment is enabled for eligible products, subscribing to the program means you agree to the following:
- Discount: Eligible subscription orders receive the discount shown at checkout
- Billing Frequency: You will be charged automatically based on the delivery frequency you select at checkout when those options are available
- Billing Amount: You will be charged the current price of your selected products (minus the subscription discount) plus applicable shipping and taxes. Prices are subject to change with 30 days advance notice.
- Payment Method: The payment method you provide at sign-up will be charged automatically for each renewal
- Shipping: Subscription orders follow the shipping rates, thresholds, and delivery options shown at checkout
How to Cancel
You may cancel your subscription using the available account controls or by contacting support before your next order is prepared:
- Online: Log into your account and use the cancellation option shown for your subscription
- Email: Send a cancellation request to customerservice@bigtexan.com
Cancellation timing depends on the subscription setup shown at checkout. To avoid being charged for your next delivery, cancel or contact support before your next order is prepared. If you cancel after billing has occurred, you may receive your final shipment and no further charges will be made.
Modifications
Available modification options depend on the subscription controls enabled for your account. If skip, pause, cadence, product, or address changes are available, use them before the next order is prepared. If you do not see the change you need, contact customer support.
Price Changes
If we change subscription pricing, we will notify you by email at least 30 days before the change takes effect. If you do not cancel before the new price takes effect, your continued subscription constitutes acceptance of the new price.
Product Substitutions
If a product in your subscription is temporarily unavailable, we may substitute a comparable product of equal or greater value. We will notify you of any substitutions by email.
Express Consent: By subscribing, you provide your express informed consent to the recurring charges described above, as required by the Restore Online Shoppers' Confidence Act (ROSCA) and applicable state auto-renewal laws.
Intellectual Property
All content on this Website, including but not limited to text, graphics, logos, images, photographs, video, audio, and software, is the property of Big Texan Steak Ranch or our licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

- Any third-party claims related to products you have purchased and subsequently gifted, shared, or distributed to others
- Your negligent or willful misconduct
- Any User Content you submit to our Website
- Your violation of any applicable laws or regulations
Disclaimer of Warranties
THE WEBSITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Website will be uninterrupted, error-free, or free of viruses or other harmful components.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BIG TEXAN STEAK RANCH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE WEBSITE OR PRODUCTS, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL.
Our total liability for any claim arising from your use of the Website or products shall not exceed the amount you paid for the specific product giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND TO HAVE A JURY TRIAL.
Informal Resolution First
Before filing any formal dispute, you agree to contact us at customerservice@bigtexan.com and attempt to resolve the dispute informally for at least 30 days. Most concerns can be resolved this way.
Binding Arbitration
If informal resolution does not resolve your dispute, you and Big Texan Steak Ranch agree that any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Website, or any products purchased through the Website shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules.
- Arbitration will be conducted by a single arbitrator in Amarillo, Texas (or by phone/video if you prefer)
- The arbitrator's decision is final and binding
- Judgment on the arbitration award may be entered in any court of competent jurisdiction
Class Action Waiver
You and Big Texan Steak Ranch agree that all disputes shall be resolved on an individual basis only. You waive any right to participate in a class action, class arbitration, or any other representative proceeding. The arbitrator may not consolidate claims or preside over any class or representative proceeding.
Small Claims Exception
Notwithstanding the above, either party may bring an individual action in small claims court for disputes within the court's jurisdictional limits.
30-Day Opt-Out
You may opt out of this arbitration agreement by sending written notice to customerservice@bigtexan.com within 30 days of your first purchase, with the subject line "Arbitration Opt-Out." Your notice must include your full name, order number, and mailing address. If you opt out, you may pursue claims in court, but the class action waiver still applies to the fullest extent permitted by law.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.
For disputes not subject to arbitration, any legal action or proceeding shall be brought exclusively in the state or federal courts located in Potter County, Texas. You consent to the personal jurisdiction of such courts.
General Provisions
- Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
- Entire Agreement: These Terms, together with our Privacy Policy and any applicable subscription terms, constitute the entire agreement between you and Big Texan Steak Ranch regarding your use of the Website.
- Assignment: We may assign our rights and obligations under these Terms without your consent in connection with a merger, acquisition, sale of assets, or by operation of law. You may not assign your rights under these Terms.
- Waiver: Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
- Force Majeure: We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, pandemics, supply chain disruptions, carrier delays, government actions, or extreme weather conditions.
- Electronic Communications: By using our Website and providing your email address, you consent to receive electronic communications from us, including order confirmations, shipping updates, and (with your consent) marketing messages.
Changes to Terms
We may modify these Terms of Service at any time. The "Last Modified" date at the top of this page indicates when the terms were last revised.
